What will happen if I go to court for claiming more than one dependent on my tax return?

When I tried to file my 2009 taxes, my ex husband had claimed all three dependants on his return when he was only to claim 1. At that time we were seperated. We finally got divorced Sept 2010. In our divorce decree it stated were were to refile those taxes but this did not happen since my ex husband refused to go to a tax professional and the extention period ran out. So on the 2010 tax I claimed all 3 dependants. I was only supposed to claim 2 out of the 3 dependants so now he is taking me to court. I have no job, I am on welfare and going to school and have no assets. I'm wondering what will happen?
