Should the tax refund be evenly split?

I had filed joint tax forms with my husband. I am now separated from my husband but I am not divorced. If we receive a refund, can it be evenly split? My husband paid most of the taxes but I still think that this would be a fair split.

Unfortunately, I believe that is something that you and your husband will need to agree on. I would recommend speaking with your CPA if you have further concerns. Also, you can always ask the IRS to issue two separate refund checks and/or have it deposited into two different accounts. However, I believe you would need the agreement of your husband.

The check will be made out to both of you. You are equally entitled to the proceeds.
